Our commitment and how to reach us

Zohii Labs respects your privacy. If you have questions or concerns about this Privacy Policy, wish to lodge a complaint, wish to be removed from our mailing list, or wish to exercise any privacy right described below, contact us at hello@zohiilabs.com. We will respond within a reasonable period and, where required by law, within the timeframe the law prescribes.

We employ industry-standard security measures, such as encryption for sensitive information, to protect the information we hold against loss, misuse, and unauthorized access, disclosure, alteration, and destruction. No method of transmission over the internet or method of electronic storage is completely secure, however, and we cannot guarantee absolute security. In the event of a data breach affecting your personal information, we will notify you and the appropriate authorities as and when required by applicable law.

How and why we collect information

We collect information that you give us directly and a limited amount of information that is generated automatically when you use the Site. Information you provide directly may include your name, email address, mailing or shipping address, phone number, the contents of messages you send us, and — where you opt in to text messages — your date of birth, which we use only to establish that you meet the minimum age for that program and to evidence that check in our consent records. Information collected automatically may include your IP address, browser and device type, operating system, referring page, the pages you view, and the dates and times of your visits.

We do not collect or store credit card information. Payments, if and when we offer products for sale, are processed by third-party payment processors that maintain their own security and privacy practices.

We use the information we collect to:

• provide, operate, and improve the Site and our products;
• respond to your inquiries, requests, and customer-service needs;
• process, fulfill, and communicate with you about orders and shipments;
• send you marketing communications, newsletters, offers, and product updates where you have opted in or where otherwise permitted by law;
• personalize your experience and understand how visitors use the Site;
• maintain the security and integrity of the Site and prevent fraud, abuse, and other unlawful activity; and

Cookies, pixels, and analytics

The Site uses cookies, tracking pixels, and similar technologies to remember your preferences, keep the Site functioning correctly, and measure traffic and engagement in aggregate. Some of these technologies are set by third-party analytics providers acting on our behalf. Most browsers allow you to refuse or delete cookies through their settings; if you do so, some parts of the Site may not function as intended. Where your browser or device sends a recognized opt-out or “Do Not Track” preference signal, we honor it to the extent required by applicable law.

How we share information

We do not sell or rent your personal information to third parties for their marketing purposes. We share personal information only in the following circumstances:

• with service providers and vendors — such as hosting, analytics, email, shipping, and payment providers — who process information on our behalf under confidentiality obligations and only for the purposes we specify;
• when required to comply with applicable law, regulation, legal process, subpoena, or a governmental or law-enforcement request;
• in connection with a merger, acquisition, financing, reorganization, sale of assets, or similar corporate transaction, in which case your information may be among the assets transferred;
• to enforce these Terms, investigate potential violations, or protect the rights, property, or safety of Zohii Labs, our customers, or the public; and
• with your consent or at your direction.

Exceptions to this Privacy Policy

Notwithstanding anything else in this Privacy Policy, we may disclose information as necessary to respond to legal inquiries and lawful process, to investigate and address suspected fraud or a security breach, and to transfer information in the course of a corporate restructuring as described above. Information you make public yourself — for example, in a product review, testimonial, social media post, or other public forum — is not confidential, and we are not responsible for the use others make of it.

Your choices and privacy rights

You may unsubscribe from our marketing emails at any time by using the unsubscribe link in any such message or by emailing us at hello@zohiilabs.com. We may still send you transactional messages relating to an order or your account.

Depending on where you live, you may have the right to request access to the personal information we hold about you, to request its correction or deletion, to request a copy of it in a portable format, to opt out of certain uses of it, and to be free from discrimination for exercising these rights. To make a request, contact us at the address above. We may need to verify your identity before acting on a request, and we will honor it to the extent required by applicable law.

We retain personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, to comply with our legal obligations, to resolve disputes, and to enforce our agreements.

Outside websites

The Site may contain links to websites operated by third parties. Those websites have their own privacy policies, which differ from ours, and we have no control over and accept no responsibility for their content, practices, or handling of your information. We encourage you to review the privacy policy of any outside website before sharing data with it.

SMS and mobile texting

We send text messages only to individuals who have expressly opted in to receive them, consistent with the Telephone Consumer Protection Act (TCPA) and other applicable law. Where you opt in, you agree to receive recurring automated marketing and promotional text messages — such as special offers, product updates, and restock alerts — at the mobile number you provide. You must be at least 21 years of age to opt in: we collect your full date of birth at the point of opt-in, calculate your age from it before any consent is recorded, and block submissions that do not meet that minimum, both in the form and again on our server. Consent to receive text messages is not a condition of any purchase.

Message frequency varies. Message and data rates may apply, and your mobile carrier’s standard rates and fees will govern. You may opt out at any time by replying STOP to any message or by emailing us at hello@zohiilabs.com; reply HELP for assistance. Carriers are not liable for delayed or undelivered messages. Phone numbers we collect are protected using encryption, and mobile opt-in information and consent are never shared with third parties for their own marketing purposes.

Where your information is processed

Zohii Labs is based in the United States, and the information we collect is processed and stored in the United States. If you access the Site from outside the United States, you understand that your information will be transferred to, and processed in, a country whose data protection laws may differ from those of your country of residence.

Accessing the Site

You may use the Site only if you are able to form a legally binding contract under applicable law and are not barred from doing so. You agree to use the Site only for lawful purposes and in accordance with these Terms. You may not input, upload, or otherwise submit another person’s personal health information, credit card information, or other financial information through the Site, and you are solely responsible for any violation arising from doing so.

Orders, pricing, and payment

Where the Site offers products for sale, all orders are subject to acceptance and availability, and we reserve the right to refuse or cancel any order — including after an order confirmation has been sent — for any reason, such as a pricing or description error, suspected fraud, or product unavailability. All prices are stated in U.S. dollars and are exclusive of taxes and shipping unless stated otherwise, and we may change prices, product offerings, and promotions at any time.

You agree to provide complete and accurate billing, contact, and shipping information, to keep it current, and to authorize us and our payment processors to charge the payment method you provide for the total amount of your order, including applicable taxes and shipping charges. Risk of loss and title pass to you upon delivery to the carrier.

Cancellations, returns, and refunds

You may request cancellation of an order before it has shipped by contacting us at hello@zohiilabs.com; once an order has shipped, it cannot be cancelled. For health and safety reasons, opened or used skincare and personal-care products are not eligible for return. Unopened products in their original, sealed condition may be returned within thirty (30) days of delivery, subject to any return policy published on the Site at the time of your purchase, which is incorporated into these Terms.

If a product arrives damaged, defective, or incorrect, contact us within fourteen (14) days of delivery and we will arrange a replacement or refund. Except as described in this section or as required by law, all sales are final and we do not provide refunds or credits.

Payment card information

We do not store your credit card information. Payment card details are collected and processed by third-party payment processors subject to their own terms and privacy practices. You may not input payment card data belonging to another person without that person’s authorization, and you are responsible for any violation, chargeback, or loss resulting from doing so.

Confidentiality and restrictions

“Confidential Information” means non-public information disclosed by one party to the other that is designated as confidential or that a reasonable person would understand to be confidential given its nature and the circumstances of disclosure. Each party agrees to protect the other’s Confidential Information using at least a reasonable standard of care and not to disclose it except as permitted by these Terms or required by law.

All content on the Site — including text, formulations and ingredient descriptions, graphics, photographs, illustrations, logos, trademarks, trade dress, layout, and software — is owned by Zohii Labs or its licensors and is protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and view the Site for your personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works from, publicly display, frame, scrape, data-mine, reverse engineer, or otherwise exploit any part of the Site without our prior written permission. All rights not expressly granted are reserved.

No reliance

The information and content we present on or through the Site is made available solely for general informational purposes. We do not warrant that it is accurate, complete, current, or suitable for any particular purpose, and we disclaim all liability arising from any reliance placed on it by you or by anyone who may be informed of it. Any reliance you place on such information is strictly at your own risk.

Cosmetic products; no medical advice

Our products are cosmetic and personal-care products intended for external use only. Statements made on the Site have not been evaluated by the U.S. Food and Drug Administration, and our products are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Individual results vary, and nothing on the Site is a guarantee of any particular outcome.

Nothing on the Site constitutes medical, dermatological, or other professional advice, and it is not a substitute for consultation with a qualified healthcare provider. Always read the full ingredient list and directions before use, patch test before first use, discontinue use if irritation occurs, and consult your physician before using any product if you are pregnant or nursing, have a known allergy or skin condition, or are taking medication. Keep products out of reach of children and avoid contact with eyes.

User content

You retain ownership of any content you submit to or through the Site, including reviews, photographs, comments, and messages (“User Content”). By submitting User Content, you grant Zohii Labs a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, adapt, publish, translate, distribute, and display that User Content in connection with the Site and our business. You represent that you own or have the necessary rights to your User Content and that it does not infringe the rights of any third party or violate any law.

We do not undertake to monitor User Content, but we reserve the right — without obligation — to modify, refuse, or remove any User Content at our sole discretion and without notice.

Prohibited uses

You agree not to, and not to permit any third party to:

• use the Site in any way that violates any applicable law or regulation;
• impersonate any person or entity or misrepresent your affiliation with any person or entity;
• introduce viruses, malware, or any other material that is malicious or technologically harmful;
• attempt to gain unauthorized access to the Site, its servers, or any connected system or network;
• use any robot, spider, scraper, or other automated means to access the Site or collect information from it; or
• interfere with, disrupt, or place an unreasonable load on the Site or its infrastructure.

Third-party communications

If the Site enables you to send emails, text messages, or other communications to third parties, you represent and warrant that each recipient has expressly consented to or otherwise opted in to the receipt of such messages. Zohii Labs maintains a zero-tolerance policy toward unsolicited commercial messaging, and we reserve the right to suspend or terminate access for any user who violates this section.

Disclaimers

THE SITE AND ALL CONTENT, PRODUCTS, AND SERVICES MADE AVAILABLE THROUGH IT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that defects will be corrected.

We are not liable for hacking, unauthorized access to or alteration of your transmissions or data, loss or corruption of data, or the conduct of any third party on or in connection with the Site. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ZOHII LABS AND ITS OFFICERS, MEMBERS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE SITE, ANY PRODUCT, OR THESE TERMS, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE, ANY PRODUCT, OR THESE TERMS EXCEED THE GREATER OF THE AMOUNTS YOU PAID TO ZOHII LABS IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you, and nothing in these Terms limits liability that cannot be limited by law.

Indemnification

You agree to defend, indemnify, and hold harmless Zohii Labs and its officers, members, employees, agents, suppliers, and licensors from and against any claims, demands, liabilities, damages, losses, costs, and expenses — including reasonable attorneys’ fees — arising out of or relating to your violation of these Terms, your misuse of the Site or any product, your User Content, or your violation of any law or the rights of any third party.

Links

These Terms apply only to websites and services operated by Zohii Labs LLC. We are not responsible for the content, accuracy, availability, or practices of any third-party website linked from the Site, and a link does not imply endorsement. We reserve the right to withdraw linking permission to the Site at any time.

Information changes

Information on the Site — including product descriptions, ingredients, pricing, and availability — may be changed, corrected, or removed at any time without notice. We are not obligated to update any information on the Site.

Submissions

Any unsolicited ideas, suggestions, concepts, formulations, artwork, or other materials you send to us (“Submissions”) become our property. We are under no obligation to maintain any Submission in confidence, to pay compensation for any Submission, or to respond to it, and we may use, reproduce, and distribute any Submission for any purpose without restriction.

Term and termination

These Terms remain in effect for as long as you use the Site. We may suspend or terminate your access to the Site or any part of it at any time at our discretion, with or without notice and with or without cause. You may terminate these Terms by ceasing all use of the Site. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution — will survive.

Parental permission and children’s privacy

The Site is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If you are under 18, you may use the Site only with the permission and supervision of a parent or legal guardian who agrees to these Terms on your behalf. We reserve the right to restrict access to the Site on the basis of age. If you believe a child has provided us with personal information, contact us at hello@zohiilabs.com and we will delete it.

Governing law; disputes

These Terms and any dispute arising out of or relating to them or to the Site are governed by the laws of the State of Wyoming, without regard to its conflict of law principles.

Before filing any claim, you agree to first contact us at hello@zohiilabs.com and attempt to resolve the dispute informally for a period of at least thirty (30) days. If the dispute is not resolved informally, it will be settled by binding arbitration administered in Sheridan County, Wyoming, under the rules of a recognized arbitration provider, except that either party may bring an individual claim in small claims court or seek injunctive relief to protect intellectual property rights.

TO THE EXTENT PERMITTED BY LAW, YOU AND ZOHII LABS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Any claim must be brought within one (1) year after it arises or it is permanently barred.

Miscellaneous

These Terms constitute the entire agreement between you and Zohii Labs regarding the Site and supersede all prior understandings on that subject. If any provision is held unenforceable, that provision will be modified to the minimum extent necessary and the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our prior written consent; we may assign them freely. Section headings are for convenience only and do not affect interpretation.

We conduct our communications in a manner intended to comply with the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and other applicable communications laws. By using the Site, you waive, to the fullest extent permitted by law, any claim of liability against Zohii Labs arising from your use of the Site other than as expressly preserved by these Terms.

Who is responsible for this program

Zohii Labs LLC, a limited liability company organized in the State of Wyoming and operating from Jacksonville, Vermont, United States, owns and operates this text messaging program. Zohii Labs LLC is the sole entity responsible for obtaining, recording, honoring, and managing SMS consent for this program, and the sole sender of the messages described below. The program is operated in connection with the website www.zohiilabs.com, which Zohii Labs LLC also owns and operates.

We use a licensed communications platform provider to transmit our messages. That provider acts only as our service provider, processing information on our instructions, and is not permitted to use your number or your consent for its own purposes. No other person or business sends messages under this program, and we do not sell, rent, share, or lend this program or its subscriber list to anyone.

Questions about this program, including any question about consent or about a message you have received, can be sent to hello@zohiilabs.com and will be answered by Zohii Labs LLC directly.

Program name and purpose

The program is called Zohii Labs Alerts. Its purpose is to send subscribers who have asked for them recurring automated marketing and promotional messages about our skincare and wellness products, and to answer customer-care questions from subscribers who text us.

How you opt in

We text only people who have asked us to. The only way to join this program is to complete the contact form at www.zohiilabs.com/#contact, where you enter your own mobile number, enter your full date of birth, and tick a consent box that is never pre-ticked and is never bundled with any other permission. We do not buy, rent, or import phone lists, we do not opt in numbers on anyone else's behalf, and consent to receive text messages is not a condition of any purchase.

The consent language you agree to at that form reads, in full:

I agree to receive recurring automated marketing and promotional text messages (e.g., special offers, product updates, restock alerts) from Zohii Labs LLC at the phone number provided. Consent is not a condition of any purchase. Message frequency varies. Message and data rates may apply. Reply STOP to cancel or HELP for help. View our Privacy Policy and SMS Terms of Service.

When you submit that form we record the wording above, the number you gave, your date of birth and the age it establishes, and the date and time of the opt-in. That record is what we produce if a carrier or regulator asks us to show that a given number consented.

Age requirement — you must be 21 or older

Our formulations are peptide-based, and this messaging program is therefore age-restricted. You must be at least 21 years of age to opt in to or remain subscribed to it.

We do not accept a voluntary age declaration for this. The opt-in form requires your full date of birth — month, day, and year — and calculates your age from it before any consent is recorded. A date of birth that does not meet the minimum age is refused: the form blocks the submission and states why, and our server independently refuses the same submission if it is sent anyway, so no phone number, consent, or subscription is created for anyone under 21. An incomplete or impossible date is likewise refused.

We do not knowingly send marketing messages to anyone under 21. If we learn that a subscriber is under 21, we remove the number from the program and delete the associated consent record. If you believe someone under 21 has been subscribed, tell us at hello@zohiilabs.com and we will remove them.

What we send, and how often

Subscribers receive recurring automated marketing and promotional messages, which may include:

• special offers, discounts, and promotions;
• new product announcements and product updates;
• back-in-stock and restock alerts; and
• replies to customer-care questions you text us.

Message frequency varies — we send in step with our promotions and with your own inquiries rather than on a fixed schedule. Messages are sent from the toll-free number registered to Zohii Labs LLC.

Message and data rates

Zohii Labs LLCdoes not charge you for these messages, but message and data rates may apply. Your mobile carrier's standard rates, fees, and plan terms govern every message you send to or receive from us, and any question about those charges is one for your carrier.

Delivery, carriers, and devices

Delivery depends on your carrier, your device, and your coverage, none of which we control. Mobile carriers are not liable for delayed or undelivered messages. Messages may not be deliverable to every carrier or to every device, and we cannot guarantee that any particular message will arrive.

Reply STOP to cancel

You may leave the program at any time and at no cost by replying STOP to any message we send you. We will send one final message confirming that you have been unsubscribed, and after that we will not send you further marketing messages unless you opt in again. You can also ask us to remove your number by emailing hello@zohiilabs.com.

Opting out of text messages does not unsubscribe you from our emails and does not affect any order you have placed; those are handled separately and are described in the Privacy Policy above.

Reply HELP for help

Reply HELP to any message for assistance, or contact us at hello@zohiilabs.com. We answer within a reasonable period and, where the law sets one, within the time it prescribes.

If your number changes

You agree to notify us if you give up or transfer the mobile number you opted in with, and you agree that the number you provide is one you are authorized to use. Telling us at hello@zohiilabs.com lets us stop messaging a number that is no longer yours.

Your number, your consent, your date of birth

Mobile opt-in information and SMS consent are never shared with or sold to third parties for their own marketing purposes. We share your number only with the communications platform provider that transmits our messages, which processes it on our behalf under confidentiality obligations, and only as needed to deliver the messages you asked for.

The date of birth you enter at the opt-in form is used to establish that you meet the minimum age for this program and to evidence that check in the consent record. It is not used for marketing, profiling, or advertising, and it is not shared for those purposes. Phone numbers we hold are protected using encryption. The Privacy Policy above describes in full what we collect, why, how long we keep it, and the privacy rights you can exercise.

Changes to these SMS Terms

We may update these SMS Terms of Service from time to time. The “Last updated” date at the top of this page reflects the most recent revision, and this section always shows the terms currently in force. If we change the program materially we will say so here; continuing to participate after a revision means you accept the updated terms, and you can always leave by replying STOP. These SMS Terms are governed by the laws of the State of Wyoming, and the dispute-resolution, disclaimer, and limitation-of-liability provisions of the Terms of Use apply to them. We conduct our messaging in a manner intended to comply with the Telephone Consumer Protection Act (TCPA) and other applicable communications law and carrier requirements.
